Introduction
Jlist.co.uk (“we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy to address claims of copyright infringement. This policy outlines the procedure for copyright owners to notify us of alleged infringements and for users to respond to such claims.
Copyright Infringement Notification
If you are a copyright owner or an agent thereof and believe that any content on jlist.co.uk infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Agent with the following information in writing:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. Please provide information reasonably sufficient to permit us to locate the material (e.g., the URL of the page where the material is located).
- Your contact information, including your full name, mailing address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature.
Please send your DMCA notice to our Designated Agent. Failure to include all of the above information may result in a delay in processing your request or may render your notification invalid.
Counter-Notification
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our Designated Agent. To be effective, a counter-notification must be a written communication that includes the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if you are outside of the United States, for any judicial district in which J-List may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the complaining party. The complaining party will then have 10 business days to notify us that they have filed a legal action seeking a court order to restrain you from engaging in the infringing activity. If we do not receive such notification, we may reinstate the material.
Repeat Infringers
In accordance with the DMCA and other applicable law, J-List has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
